Well it's sorta leagal... Heh (not ileagal till you get caught...) Nah actualy you can legaly have the rom in your posetion for 24 hours, if you don't own the actual game cartridge. Otherwise you are alowed to have a "back-up" copy as long as you own the original cartrige.

GUY
[Names have been changed to protect the inocent]

IO, you just proved your ignorance.
You CANNOT legally download ANY ROM, even if you own it. You CANNOT keep it legally for 24 hours, EVEN if you OWN it. You can in no way, shape, or form transfer ROMS over the internet unless complete ownership rights have been sent as well.

Think of it as giving you're friend your favorite book to read. You can't read it at the SAME time as your friend. You can't both have that book at the same time.

it is to legal....TRUST ME :'P
Just like NAPSTER...
If you have the actuall CD then you have the rights to that disc...YOU yourself can make copies of what ever you purchase and have the rights for......just not the stuf fyou don't have...think of it as a 24- HOUR "TRAIL VERSION" of the program....
...And that's all i have to say about That...
Ok I didn'to mean to make any one mad and it turns out your partialy right Moose (sorry) the whole 24 hour thing may just be a line. But have you ever actualy downloaded rom files I mean gosh all of the sites, ftps ect. have little disclamers that state the same as what I said earlier. Now to dig myself a deeper hole in to the questionable realm if "COPYRIGHTS." It's more a question of morals. As a programmer I would say yes it's illeagal but take napster for instance. Have you ever used napster? Read the disclamer there. To further my case it is leagal because not everyone has the equiptment to make "softcopy" of there cartrige "hardcopy." Now when we go in to nintendo they say it's ileagal nomater what the government says.

IOIOIOOIOI

Alright. All data transfers of copyrighted materials are illegal. I don't care if you have the CD or the Cartridge or whatever. It's called the law. Not that it matters anyway since everyone does what they want to on the internet with minimal to nill consequences. It is illegal, whether or not you have the data already.
You guys really need to read so you know exactly what you're doing. Each and every ROM or MP3 you download could end up costing you $150,000 dollars, and that's before the attorney fees. Read some stuff guys, it will help you in the long run, it could even lessen then penalty if you plead guilty or something.

Ok to truthfuly porve my ignorance I did some MORE homework. I looked a little more indepth to the "Copyright Law of the United States of America." If you go and look up the "Computer Maintenance Competition Assurance Act" of 1980 you would notice section 117 was amended completly and it clearly states my point. If you don't belive me check this out...

If you have an objection to this please tell me beacause I must not understand this thing verey well.

besides your right everyone does what they want on the internet anyway...

The way I see it is... if the company stops producing/selling games for the system, then it should be legal.
Dre, I completely agree. It's not like anyone is selling the game anymore, so they aren't losing any money, but probably gaining future support.

Well, my take on it is this (which doesn't make it any more legal). When you buy the cartridge you get the right to own and execute that piece of software. Unlike PCs, which are based on an open standard and are manufactured by many different companies, game consoles are monopolized and manufactured by a single company. Thus when a company stops manufacturing the console, the consumer should have the right to protect their investment, and continue executing their software using 3rd party hardware (virtual or otherwise).

Just because a particular game is no longer being burnt onto roms hardly negates the copyright of the author. That's like saying it's okay to xerox off a book and distribute it just because it is not in print at that very moment. :)

Dan East
