How can your friend develop "an open source engine for Command & Conquer?"

Does he own the code base to C&C? If not, he's walking on very thin ice because chances are, Westwood/EA will slap him with a pretty good lawsuit.

no. He built the engine himself, it just so happens that it can read Red Alert data files and interpret them properly, that's all.
