Abandonware- is it legal?

I have a question- is abandonware legal? It seems close to warez to me.

Klick and Play, for example, is now the Games Factory, but they're distributing Klick and Play as abandonware... is it legal to download abandonware?

What defines something as abandoned?

I was using flash abandonware today to download several programs for DOS which I do own a license to, however couldn't install anymore due to the fact that they were on those HUGE floppy disks (forget their size- about 5").
